Traditional background screening identifies past behaviors of job applicants that may be unacceptable. While important, this is only a part of the complete picture. Social media searches identify an applicant’s current behavior, and this information provides a more complete picture of job applicants. Many employers are conducting social media checks with internal resources. This practice exposes the employer to charges of hiring discrimination because they cannot “unsee” federal or state protected class information that can be found on social media sites.

In this session we will review a social media search technique that protects employers from charges of hiring discrimination, and is fully compliant with the FCRA and Title VII. Attendees of this session will learn how to use social media searches to improve their pre-employment screening process, and avoid charges of hiring discrimination.
